Addressing Inappropriate Treatment of Dealers by OEMs • CNCDA continues to hold manufacturers' feet to the fire when it comes to unfair treatment of their dealer partners including direct competition. • CNCDA filed a petition at the California New Motor Vehicle Board (NMVB) and successfully convinced the Board to order a DMV investigation into the Care by Volvo (CbV) program, alleging multiple violations of the California Vehicle Code. Allegations include competition between manufacturer and dealers, failure to give written notice to franchisees and the Board about CbV, preferentially allocating vehicles and sales to dealerships controlled in part by Volvo and the use of payment packing by the automaker. • CNCDA views the NMVB’s order as an important step toward further protecting the integrity of the franchise system, and we can expect a written report on the results of the investigation by mid-February. 5. Privacy • AB 1146, a CNCDA-sponsored bill for 2019 focused on addressing safety and privacy issues for California’s new car dealers, also passed the state legislature and received the approval of Governor Newsom. • The bill goes into effect on January 1, 2020, and creates a narrow exemption to the California Consumer Privacy Act (CCPA), allowing vehicle own- ership information to be shared between a new car dealer and the vehicle’s manufacturer in anticipation of or during a vehicle warranty or recall repair. • While AB 1146 is a victory for California dealers, con- cerns about consumer privacy remain strong, includ- ing a proposed ballot measure by the proponents of the CCPA. We will remain engaged in this issue as additional proposals develop and will fight to mini- mize the impact to the business conducted with your customers and in your dealerships. I’m proud of CNCDA’s 2019 leadership and our committed staff, who all continue to work hard every day to better the franchised new-car industry in California. Without their dedication and the support of each member statewide, the road ahead would only be more treacherous.
